Legal support during government procurement of computer equipment, representing the client’s interests at the Russian Federal Antimonopoly Service

Our client regularly bids on government contracts and often comes across violations, including violations by customers. FBK Legal advised the company on complicated matters arising during the bidding process, prepared complaints about customers’ actions where it was necessary to protect the client’s interests.

In 2020, the client planned to bid on a government contract for the procurement of equipment for RUB 0.5bn, but the Federal Antimonopoly Service cancelled the procurement for various reasons after complaints from competitors who could not supply the equipment themselves but did not want to lose a market share. The company asked FBK Legal to advise it how to make a bid and avoid later cancellation of the procurement by the competition regulator.

We found a proper solution and provided required consulting support to the client. As a result, it managed to make its bid, win the tender and enter into a government contract by the end of the year.

It was extremely important to observe deadlines during that procurement both for our client and the government customer as budgetary funding of government procurement is subject to strict regulations. If a government customer fails to enter into a contract, accept goods and pay for them by the end of the calendar year, the funds allocated are returned to the budget and it is impossible to use them the following year — the procurement may be ruined.
