FBL Legal Lawyers Defend Yamaha Interests in Court

FBK Legal lawyers have successfully recovered a debt for supplied equipment amounting to more than RUB 200 million in favour of Yamaha by winning a lawsuit against a Russian dealer. Furthermore, FBK Legal has won a lawsuit initiated by the dealer who tried to contest a mortgage agreement used as collateral for this debt.

According to Manager of FBK Legal Corporate Practice Elena Bokareva, the dealer’s lawsuit against Yamaha for annulment of the mortgage agreement was filed when Yamaha had filed a lawsuit for debt collection and mortgage foreclosure. “By filing this lawsuit the dealer expected to suspend the proceedings in the initial case. By separating the lawsuit on mortgage foreclosure we managed to avoid suspension and recover the entire debt,” Elena Bokareva noted.

According to FBK Legal Senior Lawyer Marina Balandina, the lawsuit was particularly difficult because the defendant was contesting the equipment supply, ?It has taken a lot of hard work for us to collect source delivery documents supporting importation of each of more than 400 pieces of equipment to Russia and their delivery to the dealer?s warehouse.?
