Ekaterina Golubeva, Head of Practice at FBK Legal, has spoken at the Second All-Russian ‘Construction Law and Legal Management’ Industry Conference hosted by ProLex and Legalconf. The speakers focused on unequal contracts and the asymmetry of project risk distribution in construction, as well as discussed the hottest and most challenging topics such as construction industry digitalisation, efficiency and quality of economic justice as applied to contract disputes, engineering of legal business processes in respect to construction projects, specifics of setup and management of construction contracts, etc.

Ekaterina Golubeva spoke on the construction tax risks covering key tax risks and ways to mitigate them when replacing a party to a construction contract.

"The tax laws offer little clarity on the taxation procedures for the assignment of claims and debt under construction contracts. As a result, we have multiple approaches to taxation. For example, judicial practice has developed as many as three of them to determine the VAT base for the assignment of claims under advance payments. In such cases, a taxpayer might find it hard to decide how to tax a transaction to avoid a conflict with the tax authorities," Ekaterina noted.
