FBK Legal has organised a two-day webinar titled ?Relevant Tax Matters. Prepare Yourself for Nine-Month Reporting?. Natalia Gerasimova spoke about VAT-related changes in the third and fourth quarters of 2021: new obligations for taxpayers because of the new product traceability system, new details of VAT invoices and situations when a company becomes a tax agent when working with foreign suppliers. Alesya Khomich analysed court judgements that should be taken into account by companies, including judgements related to the calculation of the share/interest holding period in case a legal entity is reorganised to apply the zero income tax rate when such share/interest is sold. Ekaterina Golubeva spoke about the assessment of VAT on advance payments and businesses? willingness to cancel that tax. She underlined that this issue is considered in a petition published on the website of the Russian Non-government Initiative. Natalia Ryabova explained how to deduct VAT when acquiring goods, works or services from bankrupt entities, cited the position of the Russian Constitutional Court, mentioned VAT deductions for general-nature expenses (advertising and other) and shared how to calculate the three-year cap on VAT claims. She also spoke about taxation of property dividends, accounting for expenses incurred to pay a management company and expenses for oversight of subsidiaries, permanent improvements of leased property, requalification of individual contractor agreements into employment agreements, and analysed the calculation method used to determine a tax liability under Article 54.1 of the Russian Tax Code. Liliya Yulgusheva dedicated her speech to interest and dividend relief granted by double taxation treaties, qualification of dividends recognised as such as a result of the thin capitalisation rule, criteria for the application of a reduced rate based on the OECD Model Convention and the procedure applied to refund overwithheld tax. Ekaterina Dbar shared nuances of tax accounting for interest on controlled debt and explained how reduced rates of social charges may be applied by SMEs and how oversight bodies treat them. Alexey Yarzutkin spoke about tax accounting for expenses incurred to eliminate drawbacks after a KC-14 form is signed and analysed positions of oversight bodies, courts and the Russian Ministry of Finance on accounting by general contractors and customers.
