FBK Legal Participates in Nachitka Week

Elizaveta Kapustina and Anna Aktanaeva have given a lecture titled ?Property Liability of Members and Shareholders in Case of Company Bankruptcy: Losses and Subsidiary Liability? at Nachitka, the seventh annual international week of workshops organised by the Moscow Department of the Russian Association of Lawyers and the Faculty of Law of the Lomonosov Moscow State University. The lawyers told students about corporate liability in case of company bankruptcy, characteristics of a debtor controlling party and related presumptions. They shared an analysis of the law on bankruptcy and reasons for a person to be recognised as a debtor controlling party. Anna explained subsidiary liability principles in case of bankruptcy, mentioned when debtor controlling parties may be held liable and shared real-life cases. Elizaveta spoke about recovery of damages from debtor controlling parties in case of corporate bankruptcy. She helped students to understand how to prove that there are some or no grounds for recovery of damages and looked into cases supported by our firm.
