FBK Legal?s tax consultants have held a webinar at the CFOCAFE | FinTax.Top platform to share their insights into business structuring: business splits, tax compliance, tax planning (special territories) and intercompany transactions.
Taxpayers are facing more and more scrutiny from tax authorities for allegedly unlawful business splitting. Andrey Elistratov covered that topic and said that if tax authorities identify an unlawful business splitting scheme, tax claims may be rather significant. The lawyer mentioned indications of unlawful business splitting to which tax authorities pay attention and circumstances that may be taken into account by courts that consider cases of that category. Andrey cited examples of splitting schemes and explained which evidence taxpayers may use to prove that they do not apply such schemes.
Irina Fedoskina spoke about special territories and special investment regimes that provide for tax credits and underlined that geographic growth, new types of special territories and investment regimes give more opportunities for their use in business structuring both by big and small enterprises. Irina also explained how tax credits are provided and which risks may arise as a result of their application. She also shared recent changes in this area.
Ekaterina Subbotina said that tax authorities tend to pay more attention to intercompany services both in Russia and abroad, and spoke about documents which need to be studied before planning intercompany provision of services. Ekaterina covered key aspects of intercompany relations that are likely to be tested by regulators and courts and advised on risk mitigation measures.
