FBK Legal Conducts Study of Legal Mechanisms for Public-Private Partnerships
Following the introduction on 1 September 2026 of National Standard GOST R 72783–2026 ‘Public-Private Interaction. General Provisions’ aimed at unifying approaches to implementing infrastructure projects and improving transparency across the sector, FBK Legal has launched a study of public-private partnership (PPP) legal mechanisms.
The first issue is dedicated to concession agreements — the most common and practice-tested mechanism for attracting private investment to build and operate infrastructure. The concession model is compelling, as it combines the long-term nature of the project, state participation, and the ability to ensure a return on investment through predictable cash flow.
A concession allows private capital to deliver large infrastructure projects with a more balanced risk allocation, which is especially significant for capital-intensive projects with a long investment cycle, as well as to secure state support.
The findings of our study will help investors and concessionaires identify key legal risks, assess the reliability of contractual terms, allocate the parties’ obligations correctly, and provide for investment protection mechanisms in advance.
