Legal support to enter into a non-compete agreement with a raw materials supplier
Our client’s counterparty that supplied raw materials for incorporation in the materials produced by the factory (our client) proposed to enter into a non-compete agreement with our client. The company asked FBK Legal to advise whether such an agreement was legitimate.
We analysed the situation provided by the client. Our lawyers came to a conclusion that if the client entered into such an agreement, it could have been held liable for violation of the competition law. We explained the risks associated with that agreement and advised on how to arrange cooperation with the counterparty to avoid them.
