Supporting transaction approval by the Russian Federal Antimonopoly Service
A factory, our client, was planning to buy a company that produced ceramic tiles. As this was an economic concentration transaction, which involved acquisition of a 100% interest, and assets of the companies were very big, it required preliminary consent from the Federal Antimonopoly Service.
To obtain consent, it was necessary to file documents describing the group of persons because the competition regulator had to evaluate the market position of the whole group, not just one specific person. FBK Legal structured the group of persons of the seller and the buyer of the asset and supported preparation of the documentation and information package to be filed to the competition regulator.
We managed to obtain a favourable decision valid for a year. As a result, the deal was approved and the client managed to close it on time.
