Representation of the client in litigation with a social welfare agency for the recognition of the client’s family as a multi-child family
For two years of judicial proceedings, public agencies alleged that the client’s family parenting children under custody could not be recognised as a multi-child family because otherwise the benefits the client is entitled to would be doubled, which contravenes the applicable legislation. That was the reason why Law No. 60 of the city of Moscow did not classify such families as multi-child ones.
However, FBK Legal lawyers managed to defend the client in court. In the litigation for declaring illegal the refusal to issue a multi-child family certificate, for the first time ever the Moscow City Court held that laws and regulations do not prohibit to consider children under established custody to be members of a multi-child family, thus, acknowledging that social benefits envisaged for legally free children and those granted to multi-child families are not conflicting but cumulative, depending on the situation.
