Anna Grishchenkova, FBK Legal’s corporate and M&A practice manager, in her interview to RBK daily commented upon the news that the struggle of Hermitage foundation came to a legal dead end. Russian court delivered a decision, which is exactly the opposite to the decision of British court, which baffled Hermitage lawyers who initiated litigation activities for retrieving three subsidiaries associated with “Magnitsky case”. “The case is extremely interesting and demonstrative”, Anna Grishchenkova says. According to her, this dispute reminds of corporate conflicts of 2000’s, when at the same time two directors could simultaneously act in the company, two parallel registers of shareholders, this brought conflicting judicial acts. Ms Grishchenkova believes that Hermitage lawyers shall start from recovering three limited liability companies which are already liquidated at the moment, so they have to get their liquidation recognized invalid. “Otherwise all achievements and failures in litigation for recognizing the right of participation in the companies have no practical sense”, the lawyer concluded.
