One of the ‘Citizen’s roadmap? discussions, organized by the Egor Gaydar Fund was held on May 16, 2012. Journalist Olga Romanova, member of the President council for human rights, Mara Polyakova and partner at FBK Legal, Alexander Ermolenko were discussing, ?whether the court system may be controlled by the citizens?”.
According to Alexander Ermolenko ?sweeping critics of the court system is absolutely destructive?. Admitting that there are a number of problems, such as corruption among the judges, lacking of independence from executive authorities etc. , the lawyer reminded about the ?other side of medal?. That is pure quality of the judges? performance is frequently caused by overload of those. ?High quality analysis and objective conclusions, that?s what we expect from the judges just forgetting the fact, sometimes it?s physically impossible for them. The only way to request for heroism is to provide them with at least a physical opportunity?, - A. Ermolenko said.
He also addressed to the lawyers? community and the citizens in general with appeal not to keep oneself aloof from discussing the problems arising in the court system. Quite on opposite, one shall endeavor to improve the performance of any specific judge and in that way the system in general. ?There is another problem on our hands. Our judges do not consider themselves to be the ?Third power?. That is the mentality we have to change, which is rather a long process?, - FBK Partner says.
