Head of FBK Legal Dispute Resolution Practice Anna Grishchenkova, participated as a speaker in the White Nights Law Forum
3rd International White Nights Law Forum was held by LegalStudies in Saint-Petersburg on June 1 – 3, 2012. Head of FBK Legal Dispute Resolution Practice, Anna Grishchenkova made an overview of international arbitral decisions considered by the Russian courts, attending at the session ‘National legal risks management at international settlement of disputes. Case Study’.
?In spite of the fact that it?s impossible to execute in Russia interlocutory injunctions prescribed by the foreign arbitral courts, there are legal methods allowing to get interlocutory injunction in Russia, protecting in that way interests of the plaintiffs for the period when the case is considered by the foreign court”.
At the event the idea of a unified court to be created for consideration of all disputes arising out of execution of the arbitral awards was under discussion. ?In general that?s quite a reasonable idea. Being duly organized such an authority could favor unification of legal practice in execution of arbitral awards?, - Grishchenkova said.
Some other key issues related to execution of arbitral awards, in particular rules for informing participants, issues of public nature and engagement of third party, were discussed during the session. Coordinator of British-Russian Law Association Rupert D?Croose, partner at Stephenson Harwood Luis Flannerie and partner at Rochier Henrik Fiber told about their experience and specifics of juridical procedures in other countries (Great Britain, Swiss), that is receipt of interlocutory injunction, wits of prohibition, using confidential information etc.
