Often, we view intra-group transactions simply as 'moving money from one pocket to another’, treating them as low-risk and giving them far less legal scrutiny that they deserve. However, of late we are seeing courts take a completely different view of these transactions, especially when it comes to dealing with the aftermath of business nationalisation. A new owner steps in and begins aggressively challenging transactions that were executed within the limitation period. And this practice will most likely evolve given the specific nature of today’s market situation.
