D. Paramonov took part in the press conference of "Outflow of finances. What to do - "fix the tap" or readjust the mechanism?"

On 14 August 2013 on the site of Russian Taxation portal, within the framework of preparation for the International Assembly of Tax Advisers, a press conference on the outflow of capital was held with the participation of the leading consultants in the field of international taxation.

Dmitry Paramonov, FBK Legal, Tax Consulting Practice senior legal advisor, took part in the conference and, along with the other invited experts, answered questions proposed for the discussion.

The key topics discussed by the experts were:

Global competition of states for tax yields:
Where is the international tax policy heading and what will happen after the joint attack on the tax “harbours”? What should the Russian business get ready for and should it rely on fair international rules? Can the decisions developed by G8 and OECD be considered sufficient to change the situation?

Tax planning:

What is aggressive tax planning? Where is the line drawn behind which the tax planning can be called “aggressive”? Is this notion associated with the international taxation in particular and the use of differences in the tax legislations of different countries?

Withdrawal of capital:
Is there any difference in the situation with and the nature of withdrawal of capital from Russia and from foreign countries? How can the status of Russia’s legislation be evaluated in terms of the possibility to use different ways of tax evasion?

Participation of tax advisers in lawmaking:
To what extent are the tax advisers involved in the norm-setting processes in Russia? Could the situation improve if the advisers were engaged in the norm-setting activities more actively?

Within the framework of the press conference it was also planned to carry out an expert discussion of the draft decree of the Russian Federation Supreme Court of Arbitration Plenum “About the questions arising on application of the Russian Federation Tax Code Part One by the courts of arbitration “, which touches upon a number of complicated issues of tax computation and payment, but the experts decided to discuss the draft in a different format.
