Contingent liability under amicable settlement upheld in court

A well-thought out position on the claims in the amount of 50 mln roubles, including the application of Art. 317.1 “Statutory interest” of the Civil Code of Russia, facilitated reaching an accord with the defendant on, and obtain the court’s approval of the amicable settlement which guarantees repayment of a debt to the client within a short time.
“Notably, we did persuade the court to affirm the contingent liability under the amicable settlement for the client’s benefit, which clearly shows that new and forward-looking norms and regulations of the Russian Civil Code are being applied in courts. We, definitely, see these developments as positive,” Evgeniya Yusipova said.
