On 4 September 2013 Nadezhda Orlova, FBK Legal managing Partner, took part in the RIA Novosti press-conference on "Property taxes: the payment procedure".
In the course of the conference Nadezhda Orlova, FBK Legal managing Partner, who took part in the discussion as a guest and expert, clarified the aspects of contentious issues of tax payment for the land and property of physical persons.
«If you don’t agree with the cadastral value of your property, you are entitled to conduct an independent valuation and present the results to Rosreestr» - observed Nadezhda Orlova. In the regions the commissions were set up under Rosreestr for the disputes to be settled prior to the litigation. Decisions of Rosreestr may be contested in court. Changes in the cadastral property value will have an effect on the taxpayers only beginning from the next tax period, i.e. next year.
The FBK Legal managing Partner also reminded that if an individual, registered as a private entrepreneur applying the simplified system of taxation, uses all or some part of his property for business activities, such property value may be excluded from the taxable. For that matter an application should be filed to the appropriate tax inspectorate. That is applicable to such real estate as, e.g.residential property and nonresidential premises.
The press-conference was also attended by Alexander Menkov, Head of the Federal Tax Service Inspectorate ?2 for the city of Moscow, Tatyana Shkolnaya, deputy director at the Higher School of Economics' Institute of Tax Management and Real Estate Economy and Jamilya Shakirova, Head of the Business Education Center of Moscow Tax Institute.
