The Lawyer of FBK Legal on the Specifics of Application of the Law on Procurement
Sergey Ermolenko, head of FBK Legal Antimonopoly Practice, conducted a seminar for the staff of procurement departments of oil and gas companies.
Based on the analysis of the relevant arbitration practice for the last year (the second half of 2014 — 2015) Sergey Ermolenko examined the bidding procedures and the quality of procurement carried out by the companies with the participation of the State capital in accordance with Federal Law ? 223-FZ.
The speaker focused his attention on the issues of fair practice in procurement.
According to Sergey Ermolenko, active implementation of the principle of good faith in the context of the current civil rights reform surely makes a noticeable imprint on the arbitration practice in terms of corporate procurement — the courts pay more and more attention to the principle of good faith when dealing with such cases.
“The seminar was attended by over 40 employees of different companies of the oil and gas sector. It is a good opportunity for them to gain an understanding of the procurement procedures in accordance with 223-FZ in practice under the guidance of the leading Russian specialists. I am sure that will help them in their work,” added the expert.
The seminar was held within the framework of advanced training for the personnel of procurement departments conducted by Legal O&G group in collaboration with the Gubkin Russian State Oil and Gas University.
