Sergey Ermolenko Gives Comment to CEE Legal Matters
Sergey Ermolenko has commented in CEE Legal Matters on a case where the court considered the legality of the state corporation's demand for the presence of tender participants in the ratings of the Legal 500 and Chambers and Partners. In this case, the Russian lawyers proved in the Moscow Arbitration Court that such a requirement violates Russian antitrust laws. Sergey assessed the legitimacy of taking into account international ratings when choosing service providers, indicating that any procurement procedure inevitably limits competition to some extent. Our lawyer shared his opinion on the relationship between a supplier's qualifications and its position in the rating and explained in what cases the usage of ratings is acceptable and how they are most often applied.
