FBK Legal on Liquidation of Intercompany Debts in New Environment

On 19 April, Ekaterina Dbar held a webinar on liquidation of intercompany debts in the new environment.

The lawyer analysed various options of debt cancellation in groups:

·        forgiveness of debt under a loan agreement: relevant explanations from the Russian Ministry of Finance, commercial court practice. Forgiveness of earlier acquired debt

·        forgiveness of debt under a loan agreement with a foreigner: amendments to the Russian Tax Code, withholding tax

·        cancellation of debt under a supply agreement: debt forgiveness, rebates

·        debt conversion into share capital/contribution to property

·        debt relief

·        bankruptcy.

Ekaterina evaluated the impact of the restrictions on transactions with residents of unfriendly countries.
