Alexander Ermolenko, Head of Corporate Practice, FBK Legal in his interview to RBK Daily commented upon the statement of the Head of Higher Arbitration Court, Anton Ivanov, according to him, abolishment of prejudice of court decisions on civil cases of employees of investigative authorities will have the most negative effect on the whole judicial system. “Such suggestions are the signs of the trend of strengthening of executive authorities through judicial authorities, through which direct violation of the concept of separation of powers happens, Ermolenko explained. According to him, prejudice is among the essentials of functioning of the authorities system, providing predictability of decisions of state authorities, thus providing stability of economic life. “This principle imposes the required responsibility on state officers, as any of them speaks on behalf of state and the others become automatically concerned with his decision”, Alexander noted. As the expert summed up, such system works efficiently, though it is “rather inconvenient for officials, like any other system implying responsibility”.
