Alexander Ermolenko, head of FBK Legal Corporate Practice in his interview to Gazeta.ru commented on the possible transfer of Havana Entertainment Hall to KVN. According to this media Lu??r Entertainment CJSC, the lessee of Havana, requested Sergey Sobyanin, mayor of Moscow, to reconsider the decision authorizing the transfer of the building. On November 17 Russia Prime Minister, Vladimir Putin, invited Sergey Sobyanin and Aleksand Maslyakov, the owner of KVN, to discuss the problem of KVN’s “nest”. The options included Havana, an entertainment hall with 500 seats, owned by Moscow Property Department. Aleksandr Ermolenko, Head of Corporate Practices at FBK Law in his interview to the media pointed out to the fact that “a standard lease agreement usually includes termination conditions”, but, according to the expert, it is very unlikely that there is a mechanism and amount of reimbursement specified in it. To get the reimbursement Lu??r Entertainment will have to prove the loss of profits. “It will be difficult to do that, given the fact that the movie theater is owned by the state”, assumes Mr. Ermolenko.
